  33. Pres. Nixon:  John - I don't want to interrupt your statement preparing,

  35. J. Ehrlichman:  Yes, sir.  That's alright.

  37. Pres. Nixon:  But I just wanted to be sure to check the points you want with
  38.                Peterson.  He will be in just 10 minutes so, (1) Do immunity.
  39.                However, I would say that for any of the top three.

  41. J. Ehrlichman:  Uh, huh.

  43. Pres. Nixon:  In other words, so that I can, if it sort of appears that if you
  44.                want to give it to Strachan, that is ok.  See?  Don't you think
  45.                that is a good line?

  47. J. Ehrlichman:  I think that is good.  Any of the people in - The four points
  48.                as I wrote them down were to inform him that you were making a
  49.                statement; Your policy with regard to suspension and firing.

  51. Pres. Nixon:  Which is charges or indictment -
  52.  
  53. J. Ehrlichman:  Indictment for suspension and firing for conviction, which
  54.                will be in the statement that I am drafting.

  56. Pres. Nixon:  Wait a minute.

  58. J. Ehrlichman:  He'll tell the press that.

  60. Pres. Nixon:  Right.

  62. J. Ehrlichman:  Then privately to him, your policy with regard to immunity for
  63.                top people.

  65. Pres. Nixon:  Yeah, and leaks from the Grand Jury.

  67. J. Ehrlichman:  I wouldn't limit it to three.  I would say any top person,
  68.                like Dean or up.

  70. Pres. Nixon:  Yeah.

  72. J. Ehrlichman:  It will sell.

  74. Pres. Nixon:  Then I will say, as far as a fellow like Strachan, that is fine.

  81. J. Ehrlichman:  Colson, Dean, anybody of that kind, no dice.

  83. Pres. Nixon:  He has mentioned these four to me.  I will just say that.

  85. J. Ehrlichman:  And then, of course, the leaks out of the Grand Jury.  And put
  86.                it to him whether he doesn't think the later exposure would
  87.                prejudice the whole investigation and whether he shouldn't
  88.                withdraw at an appropriate time so that a replacement can be
  89.                obtained.

  91. Pres. Nixon:  Charges and - I am going to follow a policy of accepting
  92.                resignations on charges or indictment.  Is that it?

  94. J. Ehrlichman:  No.  Suspension on indictment and a resignation on conviction.

  96. Pres. Nixon:  Of course.  That is right.  Everybody would know that.
  97.                Suspension on indictment and resignation on refusing to
  98.                cooperate.  Right?

  100. J. Ehrlichman:  Or conviction

  102. Pres. Nixon:  Right.  And what about charges?  I mean remember we had that
  103.                gray area.

  105. J. Ehrlichman:  Well, there again you will have to reserve the right,
  106.                depending on the seriousness of the charge -
  107.  
  108. Pres. Nixon:  Yeah.  I will say if there is a serious corroborated charge,-
  109.  
  110. J. Ehrlichman:  Then you want him to bring it to you and you will reserve
  111.                judgment on the individual case.
